Although the field of surgical ethics focuses primarily on informed consent, surgical decision‐making, and research ethics, some surgeons have started to consider ethical questions regarding justice and solidarity with poor and minoritized populations. To date, those calling for social justice in surgical care have emphasized increased diversity within the ranks of the surgical profession. This article, in contrast, foregrounds the agency of those most affected by injustice by bringing to bear an ethic of accompaniment. The ethic of accompaniment is born (...) from a theological tradition that has motivated work to improve health outcomes in those at the margins through its emphasis on listening, solidarity against systemic drivers of disease, and proximity to individuals and communities. Through a review of surgical ethics and exploration of a central patient case, we argue for applying an ethic of accompaniment to the care of surgical patients and their communities. (shrink)

I argue that Thomas Aquinas’s Identity Formula—the statement that the “intellect in act is the intelligible in act”—does not, as is usually supposed, express his position on how the intellect accesses extramental realities (responding to the so-called “mind-world gap”). Instead, it should be understood as a claim about the metaphysics of intellection, according to which the perfection requisite for performing the act of understanding is what could be called “intellectual-intelligible being.” In reinterpreting Aquinas’s Identity Formula, I explore the notion of (...) being “in act” as an intellect or intelligible (intelligibile actu, intellectus actu), his curious comments about an “order” or “genus” of intelligibles, and the relationship of understanding and being-understood. As a background to the developments in Gaudium et spes, I will first outline the teaching on marriage in the 1917 Code and in Pius XI's 1930 encyclical Casti connubii. This will be followed by the inclusion of marriage (...) as covenant in Gaudium et spes and finally, this article will consider the significance of the concept of marriage covenant in continuity with tradition and developments since Vatican II in the theology of marriage. By contrast, López-Farjeat offers a detailed picture of lively philosophical debates between philosophers, theologians, and other intellectuals, showing how philosophy pervaded thinking in the Islamic lands and was itself enriched by serious thinking in theology and other fields.After presenting the Islamic context and the translation movement from Greek into Arabic, López-Farjeat focuses on six main themes: (1) Theologians and Philosophers on Islamic Revelation; (2) The Classification of the Sciences, Logic, and Language; (3) Philosophy and the Natural Science; (4) Metaphysics in the Islamic Philosophical Context; (5) Psychology and Theories of Cognition; and (6) Ethics and Political Philosophy. In each case, he focuses on various much-debated philosophical issues, reconstructing their evolution. He begins by highlighting the Greek background, then moves to show chronologically how and why those debates evolved. When needed, he indicates in which other section of the book the context for a particular philosopher's or theologian's specific position on a debated issue can be found. Finally, after each chapter, he gives an excellent list of further readings (mostly in English) for the reader who wishes to delve more deeply into the topic.López-Farjeat's approach highlights the liveliness and the nuances of the debates between intellectuals of various religious persuasions in a way rarely done before. Such a detailed attention to specific contexts also means that his book does not allow for a quick, easy read. It provides all the information that even someone unfamiliar with Islamic studies or ancient philosophy may need to appreciate the richness and depth of Islamic-Arabic thinking, but this amount of information requires close and slow reading. López-Farjeat's frequent references to scholarly disagreement about specific issues could make this book at times challenging for nonspecialists. This means, however, that even seasoned scholars might find something to learn from López-Farjeat's treatments of the aspects of Islamic thought they might be less familiar with. And while beginners will need some time to absorb the vast amount of information López-Farjeat provides, they will be grateful for the clear way he has organized it.Too often and for too long have historians of Islamic philosophy focused on thinkers who saw themselves as mainly Aristotelians and neglected what philosophers learned from other disciplines, in particular from theology, be it Islamic or Christian. This book shows how Christians in the Islamic world had already integrated some Greek philosophy into their thinking from an early time, when they first entered into dialogue with Islamic theologians. In turn, Islamic theologians integrated philosophical elements in their works. López-Farjeat's knowledge of Islamic theology and Eastern Christian theology allows him to show that this process of integration was not a one-way street. The Islamic milieu and its theological developments raised new questions and issues that philosophers under Greek influences had to take into account. Self-knowledge is commonly thought to have become a topic of serious philosophical inquiry during the early modern period. Already in the thirteenth century, however, the medieval thinker Thomas Aquinas developed a sophisticated theory of self-knowledge, which Therese Scarpelli Cory presents as a project of reconciling the conflicting phenomena of self-opacity and privileged self-access. Situating Aquinas's theory within the mid-thirteenth-century debate and his own maturing thought on human nature, Cory investigates the kinds of self-knowledge that Aquinas describes and the questions (...) they raise. She shows that to a degree remarkable in a medieval thinker, self-knowledge turns out to be central to Aquinas's account of cognition and personhood, and that his theory provides tools for considering intentionality, reflexivity and selfhood. The thesis of this paper is that Thomas Aquinas offers an alternative model of abstraction (the Active Principle Model) that overcomes the standard objections to abstractionism and expands our view of what an abstractionist theory might look like. I contend that this alternative model of abstraction has been invisible in plain sight, in Aquinas’s references to the mind’s abstractive mechanism as an “intellectual light.” Such language is not metaphorical but rather technical, signaling that intellectual abstraction is to be modeled on (...) the activity of physical light as he understood it from theories proposed by Avicenna and Averroes. The Active Principle Model requires us to rethink Aquinas’s account of how we come to know essences—a process that turns out to be much more tentative and incremental than previously thought. Medieval accounts of diachronically unified consciousness have been overlooked by contemporary readers, because medieval thinkers have a unique and unexpected way of setting up the problem. This paper examines the approach to diachronically unified consciousness that is found in Augustine’s and Aquinas’s treatments of memory. For Augustine, although the mind is “distended” by time, it remains resilient, stretching across disparate moments to unify past, present, and future in a single personal present. Despite deceptively different phrasing, Aquinas develops a remarkably similar (...) view when, in order to accommodate Aristotle’s view of memory to Augustine’s, he insists that an implicit self-awareness “time-stamps” all intellectual acts. According to their shared approach, diachronic unified consciousness is the result of the curious way in which the mind is both drawn into and transcends the temporal succession of its own acts. Three Canadian institutional animal care and use committees were observed over a 1-year period to investigate animal ethical evaluation. While each protocol was evaluated, the observer collected information about the final decision, the type of protocol, and the category of invasiveness. The observer also wrote down verbatim all verbal interventions, which were coded according to the following categories: scientific, technical, politics, human analog, reduction, refinement, and replacement. The data revealed that only 16% of the comments were devoted to the 3 (...) explicit ethical categories and that most of the comments were technical. However, the analysis revealed that ethical concerns were implicit in both scientific and technical comments; either ethical norms had been translated into scientific and technical language, or some of the scientific and technical comments had an impact on the ethical treatment of animals. The results are discussed in relation to previous nonobservational research that identified potential pitfalls and bias in animal ethical evaluation. (shrink)

The eleventh-century philosopher and physician Abu Ali ibn Sina (d. A.D. 1037) was known in the West by his Latinized name Avicenna. An analysis of the sources and evolution of Avicenna's metaphysics, this book focuses on the answers he and his predecessors gave to two fundamental pairs of questions: what is the soul and how does it cause the body; and what is God and how does He cause the world? To respond to these challenges, Avicenna invented new concepts and (...) distinctions and reinterpreted old ones. The author concludes that Avicenna's innovations are a turning point in the history of metaphysics. Avicenna's metaphysics is the culmination of a period of synthesis during which philosophers fused together a Neoplatonic project (reconciling Plato with Aristotle) with a Peripatetic project (reconciling Aristotle with himself). Avicenna also stands at the beginning of a period during which philosophers sought to integrate the Arabic version of the earlier synthesis with Islamic doctrinal theology (kalam). Avicenna's metaphysics significantly influenced European scholastic thought, but it had an even more profound impact on Islamic intellectual history--the philosophical problems and opportunities associated with the Avicennian synthesis continued to be debated up to the end of the nineteenth century. This article examines two medieval thinkers—Averroes and Aquinas—on the kind of causation exercised by the agent intellect in “abstracting” or producing intelligibles from images in the imagination. It argues that abstraction in these thinkers should be interpreted in causal terms, as an act whereby images in the imagination, through the power of the agent intellect, educe their intelligible likeness in a receptive intellect. This Averroan-Thomistic causal approach to abstraction offers an intriguing alternative to the usual approach to abstraction as an (...) epistemological content-sorting. The article also demonstrates the extensive common ground uniting these thinkers’ cognition theories, despite Aquinas’s well-known rejection of Averroes’s theory of separate Intellects. (shrink)

The introduction thus serves as a helpful roadmap to orient new and returning readers of Wippel's work to some of his most important writings.In a book review of this length, it is impossible to summarize adequately the content of each essay. Indeed, it would be redundant to try, given the much more authoritative content of Wippel's own introduction to the volume. Consequently, I will limit myself to highlighting one of the notable inclusions in this collection, namely, chapter 6, "Thomas Aquinas and the Unity of Substantial Form." Despite the modest title, the piece is an extensive and wide-ranging study of the development and fate of Aquinas's controversial doctrine, the anxieties it raised among his contemporaries, and the debate that raged at Paris in the late thirteenth century, and during which the doctrine appears to have narrowly escaped inclusion on the list of condemnations of 1270. Wippel correlates some interesting historical anecdotes and documentary evidence with Aquinas's series of changing formulations in discussions of the unity of substantial form. He is thereby able to document a particularly nuanced case in which Aquinas attempts to make his own thought clearer in the face of a developing controversy, but without giving up on the essentials of his own position.Nonetheless, Wippel points out that Aquinas never fully resolved the theological criticisms lodged against his position. Within the debate over the number of substantial forms in a substance, the identity of Christ's dead body in the tomb between the crucifixion and resurrection ended up becoming a test case: What makes Christ's living body and his dead body in the tomb both be identically the same body? The problem is as follows: [End Page 371] Since substantial form is what secures the identity of a substance across time, if there is just one substantial form in a human substance, and that form (the human soul) departs Christ's body in his death on the cross, then after his death whatever is left can no longer be identified as Christ's body. Disappointingly, he only asserts that Christ's dead body is numerically identical with his living body, just not "in every way"—but without explaining why he thinks this identity is preserved. The Liber de causis, a monotheistic reworking of Proclus' Elements of Theology, was translated from Arabic into Latin in the twelfth century, with an attribution to Aristotle. Considering this Neoplatonic text a product of Aristotle's school and even the completion of Aristotle's Metaphysics, Albert the Great concluded his series of Aristotelian paraphrases by commenting on it. To do so was to invite controversy, since accidents of translation had made many readers think that the Liber de causis taught that God made (...) only the first creature, which in turn created the diverse multitude of lesser things. Thus, Albert's contemporaries in the Christian West took the text to uphold the supposedly Aristotelian doctrine that from the One only one thing can emanate--a doctrine they rejected, believing as they did that God freely determined the number and kinds of creatures. Albert, however, defended the philosophers against the theologians of his day, denying that the thesis "from the One only one proceeds" removed God's causality from the diversity and multiplicity of our world. This Albert did by appealing to a greater theologian, Pseudo-Dionysius the Areopagite, and equating the being that is the subject of metaphysics with the procession of Being from God's intellect, a procession Dionysius described in On the Divine Names. Creation as Emanation examines Albert's reading of the Liber de causis with an eye toward two questions: First, how does Albert view the relation between faith and reason, so that he can identify creation from nothing with emanation from God? And second, how does he understand Platonism and Aristotelianism, so that he can avoid the misreadings of his fellow theologians by finding in a late-fifth-century Neoplatonist the key to Aristotle's meaning? As for Avicenna the human soul is a complete substance which does not inhere in the body nor is imprinted in it, asserting its survival after the death of the body seems easy. Yet, he needs the body to explain its individuation. The paper analyzes Avicenna's arguments in the De anima sections, V, 3 & 4, of the Shifā ' in order to explore the exact causal relation there is between the human soul and its body and confronts these arguments (...) with relevant passages in the Metaphysics. It argues that the causal relation between body and soul remains obscure and that, though Avicenna claims that there is a personal immortality and that the disembodied soul remains individuated, he does not provide a satisfactory ontological account for it. This article engages with the vogue for predicting the effects of the Human Rights Act 1998 by focusing on the rape prosecution and trial. The specific interest is feminist scrutiny of the right to a fair trial, particularly the concept of ‘fairness’, in light of the increasing use of disclosure rules (in Canada and England) to gain access to medical and counseling records. Transcending the two contemporary narratives of ‘victims’/women’s rights and defendants’ rights in the criminal justice system, the authors (...) argue for the infusion of the legal debate on disclosure with feminist understandings of wider cultural debates. They suggest that an increased reflexivity about intimacy, publicity and power, leading perhaps to the development of a concept of ‘democratic publicity’ (Fraser, 1997, p. 100), might help to revision the meaning of ‘relevant’ evidence in the rape trial. They also suggest that the wide-ranging cultural debate about memory, truth and history, and the emerging commitment to experimentation in responding to massive, institutionalised human rights violations (including apartheid, war crimes and child abuse) might be of use in deepening current thinking about the rape trial and listening to the ‘voice’ of the complainant. What does it mean to be an embodied thinker of abstract concepts? Does embodiment shape the character and quality of our understanding of universals such as 'dog' and 'beauty', and would a non-embodied mind understand such concepts differently? I examine these questions through the lens of Thomas Aquinas’s remarks on the differences between embodied (human) intellects and non-embodied (angelic) intellects. In Aquinas, I argue, the difference between embodied and non-embodied intellection of extramental realities is rooted in the fact that embodied (...) and non-embodied intellects grasp different kinds of universals by means of different kinds of intelligible species (intellectual likenesses), which elicit in them different “modes” of understanding. By spelling out what exactly it means to be an embodied knower, on Aquinas’s account, I argue, we can also shed new light on his mysterious claim that the embodied intellect “turns to phantasms”—the imagination’s likenesses of individuals—in its acts of understanding. Background Informed consent is often cited as the “cornerstone” of research ethics. Its intent is that participants enter research voluntarily, with an understanding of what their participation entails. Despite agreement on the necessity to obtain informed consent in research, opinions vary on the threshold of disclosure necessary and the best method to obtain consent. We aimed to investigate Australian researchers’ views on, and their experiences with, obtaining informed consent. Results Researchers reported that consent involved information disclosure, understanding and a voluntary decision. They emphasised the variability of consent interactions, which were dependent on potential participants’ abilities and interests, study complexity and context. All researchers reported providing written information to potential participants, yet questioned the readability and utility of this information. The majority reported using signed consent forms to ‘operationalise’ consent and reported little awareness of, and lack of support in implementing more dynamic informed consent procedures, such as verbal informed consent, that was fit for the purposes of their studies. Views on Human Research Ethics Committees varied. Some reported inconsistent, arduous inputs on the information form and consent process. Others expressed reliance on HRECs for guidance, viewing them as institutional safeguards. Conclusions This study highlights the importance of transparent relationships, both between researchers and participants, and between researchers and HRECs. Where the relationship with study participants was reported as more robust, researchers felt that they were better able to ensure participants made better, more informed decisions. Where the relationship with HRECs was reported as more robust, researchers were more likely to view them as institutional safeguards, rather than as bureaucratic hindrances. Conscientious and mindful researchers are paramount to ensuring the procedure accommodates individual requirements. This study advocates that when designing ethical informed consent practices, researchers should be integrated as autonomous players with a positive input on the process, rather than, in the worst case, predatory recruiters to be curtailed by information forms and oversight. II réunit des recherches inédites émanant de diverses disciplines scientifiques : pharmacologie, physiologie, biologie, toxicologie, mais aussi sociologie, anthropologie, histoire, droit et philosophie, présentées par des spécialistes des sciences sociales et des études de genre comme par des Fornnières et pionniers ayant relevé le challenge de croiser s enjeux de genre à des objets de recherche nouveaux. This paper explores the important role of critical science, and in particular of post-colonial and decolonial theories, in understanding and shaping the ongoing advances in artificial intelligence. Artificial intelligence is viewed as amongst the technological advances that will reshape modern societies and their relations. While the design and deployment of systems that continually adapt holds the promise of far-reaching positive change, they simultaneously pose significant risks, especially to already vulnerable peoples. Values and power are central to this discussion. Decolonial theories (...) use historical hindsight to explain patterns of power that shape our intellectual, political, economic, and social world. By embedding a decolonial critical approach within its technical practice, AI communities can develop foresight and tactics that can better align research and technology development with established ethical principles, centring vulnerable peoples who continue to bear the brunt of negative impacts of innovation and scientific progress. We highlight problematic applications that are instances of coloniality, and using a decolonial lens, submit three tactics that can form a decolonial field of artificial intelligence: creating a critical technical practice of AI, seeking reverse tutelage and reverse pedagogies, and the renewal of affective and political communities. The years ahead will usher in a wave of new scientific breakthroughs and technologies driven by AI research, making it incumbent upon AI communities to strengthen the social contract through ethical foresight and the multiplicity of intellectual perspectives available to us, ultimately supporting future technologies that enable greater well-being, with the goal of beneficence and justice for all. La comparaison entre vieux-saxon (vsax), et vieil-anglais (va), deux langues germaniques historiquement et linguistiquement proches, concerne dans cet article le groupe nominal au sens de Jean Fourquet (1966, publié 2000 et 201), avec une détermination ∅ ou autre que ∅, ayant trait à Dieu. Les deux textes comparés datent du IXème siècle, le poème en vieil-anglais étant la traduction de la Genèse en vieux-saxon. De ces poèmes il ne reste que certains fragments, avec une partie commune de 25 vers allitérés. (...) A partir de ces 25 lignes communes, on essaiera de déterminer le système de détermination propre à chaque langue, qui se situe à la croisée entre un système ancien et un système nouveau. Une évolution est ainsi à l’œuvre, qu’il s’agit de reconnaître dans son caractère dynamique, à partir de la façon dont Dieu est désigné en vsax comme en va. Les appellations de Dieu sont comparables sur les plans morphologique, syntaxique, lexical. Des termes du domaine séculier sont utilisés dans le domaine religieux. La différence entre les deux textes renvoie à la façon dont chaque langue tire parti des mêmes procédés. (shrink)

This article surveys a range of recent media storiesabout human gametes, pinning them to a series of widerpreoccupations within late modern life. Threepreoccupations are singled out: first, kinship andrelational identity; secondly, Nature andglobalisation; and finally, sexual difference andequality. Each one of these preoccupations has beencharacterised as iconic; debates about them are saidto crystallise who we are, especially ouruncertainties, and what we will be in the future. Byindexing these preoccupations to the stories abouthuman gametes, the article aims to upset both theincreasing (...) attempts to present assisted reproductiontechnologies as `familiar' (as Nature's `helpinghand', for example) and the recurringassumptions about this technology's alleged`novelty' and `anomaly'. The article concludesthat treating reproduction technologies, and theirregulation, as `familiar' risks complacency:equally, assumptions about their `novelty' narrowsthe search for effective explanatory tools andregulatory mechanisms. The upshot is that it might bebest for us to view reproductive technologies as bothless `familiar' and less `novel'. (shrink)

In this article, we argue that feminist legal scholars should engage directly and explicitly with the question of evil. Part I summarises key facts surrounding the prosecution and life-long imprisonment of Myra Hindley, one of a tiny number of women involved in multiple killings of children in recent British history. Part II reviews a range of commentaries on Hindley, noting in particular the repeated use of two narratives: the first of these insists that Hindley is an icon of female evil; (...) the second, less popular one, seeks to position her as a victim. In Part III, the article broadens out and we explain why we think feminist legal scholars should look at the question of evil. In large part, the emphasis is on anticipating the range of possible objections to this argument, and on trying to answer these objections by showing how a focus on evil might benefit feminist legal thinking – specifically in relation to the categories of perpetrator and victim and, more generally, in relation to laws motivated by a desire to secure women’s human rights. This article studies the fundamental shift between Paul Ramsey’s and Oliver O’Donovan’s ethics of war and so reintroduces Hegel into the debate on political ethics. The topic is approached through the notion of divine-human and political mediation, whereby Hegel’s early movement from Christology to dialectics provides the analytical framework. The article first studies the theo-logic of Paul Ramsey’s early agapist notions of war up to his transformist period. It then traces how O’Donovan fundamentally transforms Ramsey’s dialectical framework within that of (...) narrated Christology. O’Donovan’s focus culminates in the unified reign of Christ and the overcoming of Hegel’s dialectics. But it is argued that the transition to Hegel’s and Ramsey’s perspectives is constantly required in order to prevent Christian ethics from becoming ossified. The article thus hopes to initiate a comprehensive, because logical-systematic discussion of contemporary wars and war machines, especially in critical conversation with philosophers and military practitioners. In light of the successful occupation of the term ‘person’ for Personalised Medicine, it is necessary to ask what different notions of personhood practically imply. This article examines two. The first is the reductionist molecular individual, embraced by PM enthusiasts. Here the person is a contradictory dividuum, oscillating between increased autonomy and a new, infantilising tech-paternalism. The second relies on a Christ-analogical distinction of two modes. The dramatic amplitude of personal absence-presence then unfolds throughout time. This provides the logic or (...) spirit of the medical act. Drawing on the ethics of war, it will be recast as an arduous task of mending. (shrink)

This essay begins with a discussion of the primacy of the nuclear family in American drama. Our best playwrights have been strikingly preoccupied with domestic life, consistently portraying the family as a dream of solidarity and a nightmare of enmeshment. Daytime serial dramas are also stories about American domestic life, privileging a conservatively defined nuclear family and imaging conflicting hopes and fears around it. In serious as well as popular drama, illness is frequently the catalyst for familial destruction and restoration. (...) The middle portion of the essay is devoted to a definition and history of American soap opera, providing readers with a knowledge base for the final portion, a descriptive survey of the representation of medical and social issues on daytime drama. The Health Humanities Consortium was established in 2015 to “promote health humanities scholarship, education, and practice through transdisciplinary methods and theories that focus on the intersection of the arts and humanities, health, illness, and healthcare.” As the founding co-chairs of the HHC, we provide a history of the founding of this organization in this article, describing the journey of its creation, the choices and challenges it faced as a new organization, and our hopes for a rich future.
